These Terms of Service govern your access to and use of the Wholecrafted website, platform, and related services. Please read them carefully. By using the website or services, you agree to be bound by these Terms. If you do not agree, please do not use the services.
Agreement to These Terms
By accessing or using Wholecrafted's website or platform, you confirm that you have read, understood, and agree to these Terms. If you are using the services on behalf of a business, you represent that you have the authority to bind that business to these Terms.
Who May Use Wholecrafted
You must be able to form a legally binding agreement to use Wholecrafted. The platform is intended for businesses and professional use — including food manufacturers, food makers, co-packers, shared kitchen operators, and similar operations. It is not designed for personal, family, or household consumer use.
Accounts and Workspace Access
- You are responsible for providing accurate account and workspace information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- Workspace administrators are responsible for managing access and permissions for users within their workspace.
- If you believe your account has been compromised, contact us immediately at contact@wholecrafted.com.
Use of the Services
You agree not to:
- Use the service in a way that violates any applicable law or regulation.
- Attempt to gain unauthorized access to any account, system, or data.
- Interfere with, disrupt, or attempt to circumvent the security or integrity of the platform.
- Upload, transmit, or distribute malicious code, viruses, or harmful files.
- Copy, resell, sublicense, or reverse engineer the platform, except as expressly permitted by law.
- Use the service for any purpose that is fraudulent, harmful, or deceptive.
Food Production, Compliance, and Regulatory Responsibility
Wholecrafted provides software tools to help food businesses organize recipes, production workflows, inventory, batch records, traceability, costing, and compliance-related documentation. This is an important distinction — please read it carefully.
- Wholecrafted does not provide legal, regulatory, food safety, tax, accounting, or professional compliance advice.
- Wholecrafted does not guarantee that any business, product, label, facility, process, batch, record, or filing complies with FDA, USDA, CFIA, state, provincial, local health department, or other regulatory authority requirements.
- Platform templates, presets, workflow guides, compliance checks, and any other content within the platform are organizational and informational tools only. They do not constitute regulatory approvals, certifications, or professional advice.
- You are solely responsible for validating your production processes, labels, records, filings, licenses, inspections, and all compliance obligations — with the guidance of qualified food safety professionals, process authorities, legal counsel, or applicable regulatory authorities.
User Content and Business Data
You may submit recipes, formulas, ingredient data, production records, inventory data, customer and order information, company information, and other business content to the platform ("User Content").
- You retain ownership of your User Content.
- You grant Wholecrafted a limited license to process, store, and use your User Content as necessary to provide and improve the service.
- You are responsible for the accuracy, legality, and any required rights to the information you submit.
- Wholecrafted does not use your business data to provide services to other businesses or third parties.
Subscriptions, Billing, and Availability
Specific terms related to paid plans, billing cycles, renewal terms, applicable taxes, cancellation procedures, and any refund policies may be described in the applicable checkout, plan, invoice, or order terms presented at the time of purchase.
Features may vary by plan. Wholecrafted may modify, suspend, or discontinue parts of the service with reasonable notice where practical. We will make reasonable efforts to notify users of significant changes that affect their use of the platform.
Third-Party Services
Wholecrafted may integrate with or rely on third-party services for hosting, authentication, email delivery, analytics, payment processing, or other functions. These third-party services are governed by their own terms of service and privacy policies. Wholecrafted is not responsible for the practices of third-party providers.
Intellectual Property
Wholecrafted's software, design, branding, website content, text, graphics, and related materials are owned by Wholecrafted or its licensors and are protected by applicable intellectual property laws. You may not use Wholecrafted's name, logo, or branding without prior written permission.
Your business data and User Content remain yours. Wholecrafted claims no ownership of the business information you enter into the platform.
Feedback
If you provide suggestions, ideas, or feedback about the platform or website, Wholecrafted may consider and use that feedback without obligation to you and without compensation. This does not affect your ownership of your business data.
Disclaimers
To the fullest extent permitted by applicable law, the services are provided on an "as is" and "as available" basis. Wholecrafted makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Wholecrafted does not warrant that the services will be uninterrupted, error-free, or free from security vulnerabilities. Wholecrafted does not warrant that outputs, records, reports, or workflows generated through the platform will satisfy any specific regulatory, legal, food safety, or business requirement.
Limitation of Liability
To the maximum extent permitted by applicable law, Wholecrafted and its affiliates, officers, employees, and service providers will not be liable for:
- Indirect, incidental, special, consequential, exemplary, or punitive damages.
- Lost profits, lost revenue, lost data, production losses, or business interruption.
- Regulatory penalties, recall costs, inspection failures, or compliance consequences.
Where Wholecrafted's liability is not excluded, it may be limited to the total amount you paid for the services during the twelve months preceding the event giving rise to the claim, where permitted by law.
Some jurisdictions do not allow exclusion or limitation of certain damages. In those cases, the limitations above apply only to the extent permitted by applicable law.
Indemnification
Where permitted by applicable law, you agree to defend, indemnify, and hold Wholecrafted harmless from any claims, losses, damages, costs, or expenses (including reasonable legal fees) arising from your use of the services, your violation of these Terms, any unlawful content you submit, or your violation of any third-party rights.
Termination
You may stop using the services at any time. Wholecrafted may suspend or terminate your access to the services for violations of these Terms, nonpayment, security risks, legal requirements, or at our discretion with reasonable notice where practical.
Provisions that by their nature should survive termination — including disclaimers, limitations of liability, indemnification, and governing law — will continue to apply after termination.
Governing Law
Unless otherwise required by applicable law, these Terms are governed by and construed in accordance with the laws of the jurisdiction where Wholecrafted is organized, without regard to conflict-of-law principles. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts in that jurisdiction, where permitted by law.
Changes to These Terms
Wholecrafted may update these Terms from time to time. When we make material changes, we will revise the "Last updated" date. We may also notify users through the platform or by email for significant changes. Continued use of the services after changes are posted constitutes acceptance of the updated Terms where permitted by applicable law.
